Law No. 13.709, of 08/14/2018, known as the LGPD - General Data Protection Law, regulates the processing of personal data, including in digital media, by natural or legal persons, whether public or private, with the aim of protecting the fundamental rights of freedom and privacy and the free development of the personality of the natural person.
This Law came into force on September 18, 2020, and has been applied since then by public bodies such as TJ - Court of Justice, TRT - Regional Labor Court, STF - Federal Supreme Court, STJ - Superior Court of Justice, and MP - Public Prosecutor's Office, until the establishment of the ANPD - National Data Protection Authority, which started operating on 08/01/21. In addition to the mentioned public bodies, they can continue to enforce the present law or other laws related to the protection of personal data.
The LGPD has the following principles:
I - respect for privacy;
II - informational self-determination;
III - freedom of expression, information, communication, and opinion;
IV - inviolability of intimacy, honor, and image;
V - economic and technological development and innovation;
VI - free initiative, free competition, and consumer protection;
VII - human rights, free development of personality, dignity, and exercise of citizenship by natural persons.
Personal Data Protection Officer - DPO
In compliance with article 23, item III, of Law 13.709/18, CRA INFRA has designated Mr. Marcelo Ocolate Daminello as the Data Protection Officer (DPO).
